The Competition, Regulation and Supervision Court ordered the preservation of evidence by the Defendant and the third parties (shareholders) while the case is suspended.
On 2 June 2022, Ius submitted a request to the Court to order the preservation of evidence by the Defendant while the case is suspended and, on 17 June 2022, Super Bock appealed the Court’s decision to suspend the case and replied to out request for preservation of evidence, opposing it. On June 28, 2022, Ius presented its response to Super Bock’s appeal, and the process is pending in the Lisbon Court of Appeal. On July 12, 2022, the Competition Court accepted Ius’ request and ordered the Defendant and its shareholders to preserve the evidence requested by Ius, until the Court has the opportunity to analyse its necessity.
The Court’s decision is an important step in ensuring that companies will not escape responsability because the cases take long time and the evidence is disappearing.
