Meliá Case | LCA rules on international jurisdiction of Portuguese courts

The Lisbon Court of Appeal confirmed the international jurisdiction of Portuguese courts for pre-filing discovery actions to determine whether Portuguese consumers have been harmed by anti-competitive practices. In addition, it confirmed that the jurisdiction of Portuguese courts in private enforcement actions is determined by the residence of the injured consumers, as the place where the damage occurred.

The Defendant had appealed the Competition Court’s determination that the Portuguese courts have jurisdiction under the Brussels Regulation. The Lisbon Court of Appeal has now confirmed the interpretation given by the Competition Court.
