The Court of Appeal of Lisbon rejected EDP’s appeal and maintained the suspension of the popular action issued by the Competition Court to await a final decision in the public enforcement proceeding. The Judgment recognizes the importance of public enforcement proceedings for follow-on popular actions, and stresses the wisdom of leaving for a later date the decision on whether the public enforcement Decision creates an irrefutable or refutable presumption in the follow-on action.
